Silly Fox Studios is committed to protecting your privacy. We comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the EU General Data Protection Regulation (GDPR) where it applies.

This Privacy Policy forms part of our Website Terms & Conditions and explains how we collect, hold, use and disclose your personal information. It sits alongside our Custom Order Terms, which cover how made-to-order work itself is handled.

2. Who we are and how to contact us

Silly Fox Studios is a custom engraving and personalised gift workshop based in Rockhampton, Queensland, Australia.

This policy applies to sillyfox.com.au and to our social media channels. It does not cover information you submit on third-party platforms such as Instagram or Facebook — what those platforms do with your information is governed by their own privacy policies.

This policy applies to everyone — customers, enquirers, subscribers and anyone simply browsing the site.

4. Our responsibilities

We decide how and why your personal information is handled, which makes us responsible for it under Australian privacy law.

We do not sell or rent your details to anyone. We'll always be clear about what we collect and what we do with it.

If you give us someone else's personal information, you're confirming you're allowed to. This matters more here than on most sites, because custom engraving often involves other people's details — a recipient's name, a child's date of birth, a deceased person's name and dates, or a photograph of someone's handwriting. By sending us that information you confirm you have the authority to share it with us and to have it engraved.

6. When and how we collect information

We collect information when you:

• Submit an order brief through our order form
• Send us an enquiry through the contact form, by email, by phone or by social media direct message
• Supply artwork, photographs, reference images or files for a job
• Place an order, pay an invoice or arrange delivery
• Subscribe to updates, or enter a promotion, giveaway or survey
• Visit the site, where some information is collected automatically through cookies and similar technologies

Some information you give us deliberately. Some is collected automatically when you use the site.

7. What information we collect

Contact and order information

• Name, email address, phone number
• Delivery or pickup address
• What you're ordering, quantities, deadlines and how you'd like it delivered
• How you found us (if you tell us)

Content you supply for your order

• The wording, names, dates and messages you want engraved
• Photographs, artwork, logos, handwriting samples and reference images you upload or link to
• Any notes, stories or context you give us about the piece

This content frequently contains personal information about people other than you. We treat it as confidential, use it only to produce your order, and hold it under the same protections as everything else in this policy.

Business information

• Business name and ABN, for business or bulk orders
• Invoicing details

Payment information

• We do not take card payments through this website and we do not store card numbers.
• Where you pay by bank transfer or invoice, we hold the transaction record required for our accounting and tax obligations.
• We retain records of historical purchases made through our previous online shop, for the period Australian tax law requires.

Technical and usage information

• IP address, browser type and version, device and operating system, time zone, approximate location
• Pages visited, links clicked, time on page, how you arrived at the site, and how far you get through the order form

Some of this is looked at in aggregate rather than individually.

8. How we use and disclose your information

We use your information to:

• Quote, design, produce and deliver your order
• Send you artwork proofs and get your approval
• Answer your questions and provide customer support
• Keep records of orders, invoices and tax obligations
• Improve the website and the ordering experience
• Detect and prevent fraud
• Send you marketing, where you've agreed to receive it
• Meet our legal obligations

We may disclose your information to:

• Suppliers and service providers who help us run the business (website hosting, email, accounting, delivery)
• Australia Post or a courier, to get your order to you
• Our professional and legal advisers
• Law enforcement or government agencies, where required by law
• Anyone else, with your consent

Every service provider we use is subject to confidentiality and data protection obligations.

9. Showing your order in our gallery

We're proud of what we make and we may photograph finished work for our website gallery, social media and marketing. Where a piece carries a name, a date or a message, that information may be visible in the photograph.

Tell us and we won't. Just say so when you brief us, or email hello@sillyfox.com.au at any time. We'll never publish memorial pieces, surprise gifts or anything you've flagged as private without asking you first.

10. Analytics and tracking

We use analytics and tracking tools to understand how people use the site — which pages get visited, how people move through the order form, and where they get stuck. This helps us make the site work better.

Where we can, we de-identify or aggregate this information before analysing it, so it produces insight about behaviour without identifying individuals.

Automated decisions: we don't currently use computer programs to make or substantially influence decisions about you. If that changes, we'll update this policy to say what information is used and what kinds of decisions are made.

11. Google Analytics

We use Google Analytics to understand how visitors use our site. Google's own information on how it collects and processes data, and how to opt out, is available at policies.google.com/technologies/partner-sites and tools.google.com/dlpage/gaoptout.

12. Meta Insights

We use Meta Insights to understand how people interact with our content on Facebook and Instagram. Meta's Privacy Policy explains what it collects: facebook.com/privacy/policy. You can adjust what you see under "Ad Preferences" in your Facebook settings.

13. Choosing not to give us your information

You don't have to give us your personal information. But without it we can't quote, design or make your order — custom work requires knowing what you want, who it's for and where it's going. You're welcome to browse the site without giving us anything.

14. Marketing

If we collect your information intending to use it for marketing, we'll ask for your consent first, and you can withdraw it at any time.

Order-related messages are separate. Quotes, proofs, approval requests, delivery updates and invoices are part of fulfilling your order rather than marketing, and you'll keep receiving those while your order is underway.

15. Your rights

You can exercise any of the rights below by emailing hello@sillyfox.com.au or using the contact form at sillyfox.com.au/contact.

Access. You can ask for a copy of the personal information we hold about you. We'll provide it within 30 days, unless doing so would unreasonably affect someone else's rights — in which case we'll explain why.

Correction. If something we hold is wrong or out of date, tell us and we'll fix it.

Erasure. You can ask us to delete the information we hold about you. We'll do so, except where we're legally required to keep it — tax and invoicing records being the usual example.

Objection. We may analyse how you use the site to decide what's relevant to send you. Any automated decision with a significant effect on you would require your explicit consent or clear legal authority.

16. Making a complaint

If you're unhappy with how we've handled your personal information, contact us first at hello@sillyfox.com.au and we'll do our best to sort it out.

If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

If you're in the European Union, you can lodge a complaint with your local data protection authority through the European Data Protection Board at edpb.europa.eu.

Under Australian privacy law you may also have the right to take legal action for a serious invasion of privacy.

17. How we keep your information secure

We can't guarantee the security of information transmitted over the internet, but we take reasonable and appropriate physical, electronic and procedural steps to protect it, including:

• Storing data with reputable providers who maintain appropriate security
• Limiting access to people who need it
• Not storing payment card details at all
• Keeping customer-supplied photographs and artwork only as long as we need them

18. Where we store your information

Some of our service providers operate outside Australia, which means your personal information may be stored or processed overseas.

In particular, our website and our order and contact forms are hosted by Webflow, whose servers are in the United States. When you submit an order brief or an enquiry, that information — including anything you've typed into the wording field — is stored there.

Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it's handled in a way consistent with the Australian Privacy Principles.

19. How long we keep your information

We keep personal information for as long as we reasonably need it, and for as long as Australian law requires.

• Order records, invoices and payment records are kept for the period required by Australian tax law.
• Artwork, proofs and customer-supplied files are kept so we can reproduce or reorder a piece for you later. Ask us to delete them and we will.
• Enquiries that don't become orders are kept for a reasonable period and then deleted.

Once we no longer need your information, we securely delete or anonymise it.

20. Third parties who handle your information

We share information with:

• Webflow — website hosting and form submissions
• Xero — invoicing and financial records
• Australia Post and couriers — delivery
• Analytics providers — see sections 10 to 12
• Professional and legal advisers, where needed
• Law enforcement or government agencies, where required by law

We share your information with these parties only where it's necessary, where you've consented, or where the law permits or requires it.

21. Children

Our site isn't intended for children, and we don't knowingly collect personal information directly from children.

We do, however, make personalised gifts for children — christening pieces, first-birthday keepsakes, school gifts. Where you supply a child's name, date of birth or photograph for engraving, you're providing it as that child's parent or guardian, or with their parent or guardian's authority. We use it only to make the piece you've ordered.

22. Cookies

Our site uses cookies and similar technologies. Cookies are small data files placed on your device, often containing an anonymous unique identifier. We use them to make the site work, to analyse traffic, and for marketing.

You can restrict or block cookies through your browser settings, and delete existing ones the same way. Your browser's HELP section explains how, and allaboutcookies.org has general information. Blocking all cookies may stop parts of the site working properly.

23. Web beacons

We may use web beacons (small clear images) on our website and in our emails. When we send an email, these let us see whether it was opened and which links were clicked, along with technical information such as IP address and browser. We use this to make our emails more useful and less frequent. Every marketing email includes an unsubscribe link.

24. Governing law

This Privacy Policy and your use of our site are governed by the laws of Queensland, Australia.

25. Updates to this policy

We may update this Privacy Policy to reflect changes in our practices or for operational, legal or regulatory reasons. The effective date at the top of this page always shows the current version.
